1. Agreement to these terms
These Terms of Service (the “Terms”) are an agreement between you and Budgy (“Budgy”, “we”, “us”) governing your use of the Budgy mobile app for iOS and Android, the website at usebudgy.com, and the community feedback board (together, the “Service”). By downloading, accessing, or using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.
2. Budgy is not financial advice
Budgy is a personal budgeting and organizational tool. Nothing in the Service — including AI-generated categorizations, insights, summaries, or assistant responses — constitutes financial, investment, tax, accounting, or legal advice, and none of it should be relied on as such. AI output can be incomplete or wrong: numbers may be miscategorized, summaries may be inaccurate, and suggestions may not fit your situation. You are solely responsible for your financial decisions. For advice, consult a qualified professional.
3. The Service and your data
Budgy is local-first: your budgeting data (accounts, categories, transactions, notes, goals, receipt photos, and settings) is stored only on your device. The Service does not include cloud backup or sync, and we hold no copy of your budget. You are responsible for safeguarding your data — for example by using the app’s CSV/PDF export and backing up your device. If your device is lost, damaged, reset, or the app is uninstalled, your data may be permanently lost, and we will not be able to recover it.
4. Accounts
Budgy has no sign-up. The app automatically creates an anonymous, per-install identity used to verify subscriptions and rate-limit AI requests; the website creates one only if you post on the feedback board. There are no credentials to manage, which also means access to Budgy on your device is controlled by access to the device itself. You are responsible for securing your device (the app offers an optional biometric lock).
5. Subscriptions and billing (Budgy Plus)
Budgy’s core features are free. AI features require Budgy Plus, offered as an auto-renewing monthly subscription ($4.99/month), an auto-renewing yearly subscription ($49.99/year), or a one-time lifetime purchase ($149.99). Prices are set in your local currency by the App Store or Google Play and may vary; the price shown at checkout is the one that applies.
- Billing is handled by Apple or Google, not by Budgy, through the store account you used to download the app.
- Subscriptions renew automatically until cancelled. You can cancel anytime in your App Store or Google Play subscription settings; to avoid being charged for the next period, cancel at least 24 hours before it renews. You keep access until the end of the paid period.
- The 7-day free trial is managed by the app, not by the stores. It requires no purchase and simply unlocks Plus features for 7 days. Because store products carry no introductory offer, any purchase you make — during the trial or after — is charged immediately at full price.
- Refunds are handled exclusively by Apple and Google under their policies. We cannot issue refunds for store purchases ourselves.
6. Feedback board and user content
The feedback board lets you post feature requests, bug reports, votes, and comments (“User Content”). You own your User Content. By posting it, you grant Budgy a worldwide, non-exclusive, royalty-free license to host, display, and use it to operate and improve the Service — for example, building features you suggest, without obligation or compensation.
Posts are public. Do not post anything unlawful, abusive, deceptive, or infringing; do not spam; and do not include personal information (yours or anyone else’s). We may edit, moderate, or remove User Content and may restrict feedback-board access at our discretion.
7. Acceptable use
When using the Service, you agree not to:
- reverse engineer, decompile, or copy the app or website, except where law permits;
- scrape, probe, or disrupt the Service or its infrastructure;
- abuse the AI endpoints, including circumventing rate limits or subscription checks, or using them for anything other than the app’s intended features;
- use the Service for any unlawful purpose.
8. Intellectual property and license
The Service — including the app, website, design, mascot, and branding — belongs to Budgy and its licensors. We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use the app on devices you own or control, for personal, non-commercial use, in accordance with these Terms and the applicable store’s usage rules.
9. Third-party services
The Service depends on third-party services, including Apple and Google (distribution and billing), Anthropic (AI processing), Supabase, Cloudflare, RevenueCat, and PostHog. Their terms and privacy policies apply to their services, and we are not responsible for them. See our Privacy Policy for what each provider receives.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, non-infringement, accuracy of AI output, or uninterrupted, error-free operation. Some jurisdictions do not allow certain warranty exclusions, so parts of this section may not apply to you.
11. Limitation of liability
To the maximum extent permitted by law, Budgy will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data (including loss of your on-device budget data), or business interruption, arising from or related to your use of the Service. To the maximum extent permitted by law, our total liability for all claims relating to the Service is limited to the amount you paid us for the Service in the 12 months before the claim arose (or CAD $50 if you paid nothing). Some jurisdictions do not allow certain limitations of liability, so parts of this section may not apply to you.
12. Termination
You can stop using the Service at any time by uninstalling the app; deleting server-side data is described in the Privacy Policy. We may suspend or terminate your access to the feedback board or our API if you violate these Terms. Sections that by their nature should survive termination (including 6, 8, 10, 11, and 14) survive.
13. Changes to these terms
We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date, and we will provide notice in the app or on the website for material changes. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
14. Governing law
These Terms are governed by the laws of Canada, without regard to conflict-of-law rules, and disputes will be resolved in the courts of Canada, except where the law of your place of residence grants you mandatory consumer protections or a different forum.
15. App store terms
These Terms are between you and Budgy only — not with Apple Inc. or Google LLC. Where you obtained the app from the Apple App Store, the following also applies: Apple has no obligation to provide maintenance or support for the app; in the event of a failure to conform to a warranty, you may notify Apple for a refund of the purchase price, and Apple has no other warranty obligation; Apple is not responsible for addressing claims relating to the app, including product liability, regulatory, or IP claims; you must comply with the App Store Terms of Service, including its Usage Rules; and Apple and its subsidiaries are third-party beneficiaries of these Terms, entitled to enforce them against you. Where you obtained the app from Google Play, you must also comply with the Google Play Terms of Service.
You represent that you are not located in a country subject to a U.S. government embargo and are not on any U.S. government list of prohibited or restricted parties.
